Library Privacy, Procedures, and Law Enforcement

The Batavia Public Library is a welcoming and inclusive space for all members of our community. We are committed to providing equitable access, high-quality service, and unbiased information to all. Our Library serves as a safe place to learn, connect, and grow — where every individual is treated with dignity and respect.

Your Privacy Matters

We respect the privacy and confidentiality of all Library users.

  • The Library does not ask for immigration status when issuing library cards.
  • In accordance with the Illinois Library Records Confidentiality Act (75 ILCS 70/1), all library records — including registration and circulation information — are confidential and cannot be shared publicly.
    The Batavia Public Library does not assist or collaborate with U.S. Immigration and Customs Enforcement (ICE) unless legally required to do so through a valid court order.

While other local entities may operate under different regulations, the Library follows guidance from the American Library Association (ALA), the Illinois Library Association (ILA), and our legal counsel to ensure that our policies and actions are consistent with state and federal law.

Frequently Asked Questions-ICE

If Library staff encounter ICE officers on Library property, they are instructed to contact the Management Team immediately.

Staff may:

  • Request the officer’s name, badge number, and agency affiliation.
  • Document all details of the interaction through notes, photos, or video.

Staff may not:

  • Provide information or access to employee or patron records without proper authorization.
  • Allow agents into private or nonpublic areas unless a valid warrant is presented and verified.

Because the Library is a public building, ICE agents cannot be barred from entering public areas. However, library staff will promptly alert the Management Team if any ICE presence is observed and will follow established protocols.

If an ICE agent presents a warrant, find the Director or PIC immediately and they will respond to the warrant.  The Library will consult with legal counsel to ensure all actions comply with the law and that nothing beyond the scope of the warrant is released.
